Tuco Field: conditions of use

These Terms of Use ("Terms") form an agreement between you and James Foster, the publisher of the Tuco Field mobile app. By downloading or using the app, you agree to these Terms. If you don't agree, please don't use the app.

  1. 01

    Step 01Who may use the app

    You must be at least 16 years old, and able to enter into a binding agreement, to use Tuco Field. If you use it for an employer or a business, you confirm that you're allowed to accept these Terms on their behalf as well as your own.

  2. 02

    Step 02Licence to use Tuco Field

    We give you a personal, non-exclusive, non-transferable and revocable licence to install the app and use it on devices you own or control, under these Terms and the rules of the app store you downloaded it from (Apple App Store or Google Play). Where those store rules conflict with these Terms, the store rules apply to that point.

    The app, its design, code, name and logo belong to James Foster and are protected by intellectual-property law. You may not copy, modify, decompile, resell or redistribute the app, except where the law expressly allows it.

  3. 03

    Step 03Your records belong to you

    Everything you enter, including expenses, absence records, meter readings, contracts and invoice details, stays yours. It is stored on your device, as described in our Privacy Policy. We don't claim any rights over it.

    Because we don't keep a copy, you are responsible for keeping your records backed up, for example through your device's system backup. We can't restore data that is lost when a device is lost, reset, damaged, or when the app is deleted.

    Step 04Acceptable use

    You agree not to:

    • use the app to record or process personal data about others without a lawful basis, or against your employer's rules;
    • use the app to falsify meter readings, expense claims, timesheets or invoices;
    • try to get around the app's security, reverse-engineer it, or interfere with how it works;
    • use the app for anything unlawful.
  5. 05

    Step 05Professional and regulated use

    Tuco Field is a convenience tool for field workers and small businesses in energy, water and other utility sectors. It isn't certified metering, accounting, payroll or billing software. It also doesn't replace your employer's official systems, statutory records, or the legally required checks on meter readings and invoices.

    Leave balances, expense totals and contract expiry dates are calculated from what you enter and are for your own reference. You are responsible for checking them against official records before you rely on them.

  6. 06

    Step 06Purchases and updates

    If the app or any feature in it is offered for a fee, the app store handles payment, renewal and refunds under its own terms. We don't receive or store your payment details.

    We may release updates that add, change or remove features. Some updates may be needed for the app to keep working. We'll try to keep your existing records intact through every update.

  7. 07

    Step 07Disclaimers

    As far as the law allows, the app is provided "as is" and "as available". We work hard to make Tuco Field reliable, but we don't promise that it will be error-free, uninterrupted, or suitable for every purpose. Nothing in these Terms takes away rights you have as a consumer under mandatory law, including EU and Czech consumer protection law.

  8. 08

    Step 08Limitation of liability

    As far as the law allows, we are not liable for indirect or consequential losses. This includes lost income, billing errors, missed contract deadlines or lost data that come from using the app or being unable to use it. In all cases, our total liability to you is limited to the amount you paid for the app in the 12 months before the claim. If you paid nothing, it is limited to EUR 50.

    None of this limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law.

  9. 09

    Step 09Ending use

    You can stop using Tuco Field at any time by deleting it. If you seriously break these Terms, your licence ends automatically. Sections 03, 07, 08 and 10 still apply after your licence ends.

  10. 10

    Step 10Changes, governing law and contact

    We may update these Terms from time to time. When we do, we'll change the effective date on this page. If the change is significant, we'll also announce it in the app's release notes. If you keep using the app after a change, you accept the updated Terms.

    These Terms are governed by the laws of the Czech Republic, without affecting any mandatory consumer protections in the country where you live. The courts that have jurisdiction under applicable law will hear any disputes.
